We collect information about you in a variety of ways depending on how you interact with us and our websites, mobile applications and services, including:

Government-Issued Identification Documents.When you choose to pay with a wire transfer or cryptocurrency, such as through our partner BitPay, we require that you submit a copy of your government-issued ID (such as a driver’s license or passport), as required to comply with federal and state regulations and for anti-fraud investigations.We collect this information in order to comply with our legal obligations, and to help us prevent fraud.
Location InformationWhen you ask us to, we collect information about your general location (e.g., zip code).We collect general location information in order to help you find stores and products that may be close to you.
Email InterconnectivityIf you receive email from us, we use certain tools to capture data related to when you open our message, click on any links or banners it contains and make purchases.We collect this information to understand what content is of interest to you and how you interact with communications from us.
Feedback/SupportIf you provide us feedback or contact us for support through our customer service and/or call center channels, we will collect your name, phone number and email address, as well as any other content that you send to us providing such feedback. We also may collect recordings of your voice obtained through your interactions with our customer service and/or call centers.We collect this information to respond to, and act upon your feedback or issues.
Mobile DevicesWe collect information from your mobile device such as unique identifying information broadcast from your device when visiting our website or when visiting one of our stores, and for our e-warranty app your watch serial number.We have a legitimate interest in identifying unique visitors, and in understanding how users interact with us on their mobile devices.
Order PlacementWe collect your name, billing address, shipping address, email address, phone number, and credit card information when you place an order. If you choose to pay using a wire transfer or cryptocurrency we will also collect a copy of your government-issued identification documents as described above.We use your information to perform our contract to provide you with our products or services.
Partner PromotionWe collect information that you provide as part of a co-branded promotion with another company.We collect this information to fulfill your orders and provide you with our services. 
SurveysWhen you participate in a survey, we collect information that you provide through the survey. If the survey is provided by a third party service provider, the third party’s privacy policy applies to the collection, use, and disclosure of your information.We collect survey information to understand your opinions, and collect information relevant to our organization.
Sweepstakes or contestsWhen you participate in a sweepstakes or contest we collect information about you which includes contact information to notify you if you are selected.We collect this information to carry out the sweepstakes and facilitate the contests. In some contexts we are also required by law to collect information about those that enter into our sweepstakes.
Website interactionsWe use technology to monitor how you interact with our website. This may include which links you click on, or information that you type into our online forms. This may also include information about your device or browser.We collect this information to understand how you interact with our website and to understand your preferences and interests in order to select offerings that you might find most useful. Collecting this information also helps us detect and prevent fraud.
Web logsWe collect information, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to a computer when the internet is used), domain name, click-activity, referring website, and/or a date/time stamp for visitors.We collect this information to monitor our networks and the visitors to our websites. Among other things, it helps us understand which of our services is the most popular.
Event RegistrationWe collect your name, contact information, and, in some cases, interests, when you register for our events and/or sign up to receive communications from us at our events.We collect this information to keep you informed of future programming, events, and marketing communications as requested.

HOW WE USE INFORMATION.

In addition to the purposes and uses described above, we use information in the following ways:

•    For internal administrative purposes, as well as to manage our relationships.

 

•    For such other purposes as you may consent (from time to time).

At times we aggregate or pseudonymize data to help us better understand our consumers, for example to measure our sales performance, identify audience segments. We also use this to improve our products, train and fine tune algorithms and data analytics models.

 

We do not sell or share your personal information in exchange for monetary consideration. We disclose categories of personal data we collect to the categories of recipients set forth below. Different state privacy laws in the United States provide consumers the right to opt-out of certain data processing. This includes the display advertisements that are based on personal data obtained or inferred over time from an individual’s activities across businesses or distinctively branded sites, applications or services (“Targeted Advertising”, also referred to in California as “cross-context behavioral advertising”). Some states also provide the right to opt-out of “Sharing”, which includes providing or making available personal information to third parties for such Targeted Advertising activity. We may use certain personal data that you provide to advertise to you. This may include making available your personal data to certain third parties in a way that may constitute a Sale and/or Sharing, as well as using your personal data for purposes of Targeted Advertising. Automated Decision-Making 

We do not conduct automated processing of personal data for the purposes of evaluating, analyzing, or predicting an individual’s personal aspects in furtherance of decisions that produce legal or similarly significant effects. As a result, we do not provide a right to exercise control over such forms of automated decision-making.

HOW WE SHARE INFORMATION.

In addition to the specific situations discussed elsewhere in this Privacy Policy, we may disclose personal information in the following situations:


•    Affiliates and Acquisitions. We may share information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). Our parent company, LVMH Moet Hennessy Louis Vuitton (LVMH Inc.) and affiliate Maisons (listed here) may access your information where they are providing services, as otherwise described in this policy and to the extent permitted by applicable law. If another company acquires, or plans to acquire, our company, business, or our assets, we will also share information with that company, including at the negotiation stage. 

 

•    Social Media. Our site may have features such as plugins, widgets and other tools provided by social media platforms and networks that may result in information being collected and disclosed. Their use of your information is not governed by this privacy notice. 

Depending on your state of residency and subject to certain legal limitations and exceptions, you may be able to limit or opt-out of the sale of personal data or the processing of personal data for purposes of targeted advertising (as described in the Your Choices section of this Privacy Policy). 

Please note we do not sell the personal data of individuals we know to be less than 16 years of age or share such information for targeted advertising purposes.


•    Other Disclosures with Your Consent. We may ask if you would like us to share your information with other unaffiliated third parties who are not described elsewhere in this Privacy Policy.


•    Other Disclosures without Your Consent. We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the shipment of products to or the provision of services by a third-party intermediary.


•    Public. Some of our websites may provide the opportunity to post comments, or reviews, in a public forum. If you decide to submit information on these pages, that information may be publicly available.


•    Partner Promotion. We may offer contests, sweepstakes, or other promotions with third party partners. If you decide to enter a contest, sweepstakes, or promotion that is sponsored by a third party partner the information that you provide will be shared with us and with them. Their use of your information is not governed by this Privacy Policy.


•    Service Providersand Payment Processors. We may share your information with service providers, payment processors, and/or vendors. Among other things such companies may help us to administer our website, conduct surveys, provide technical support, process payments for purchases made through out site, and assist in the fulfillment of orders. For example, when you choose to make a purchase using cryptocurrency through our partner, BitPay, we will share limited personal data (first name, last name, and email address) with BitPay in order to process payment for your order, verify your identity, and comply with legal and regulatory requirements.  If you choose to pay through BitPay and/or any of our other payment processors, you should also carefully review and understand the third-party payment processor’s policies and practices as the personal and/or financial information you provide through such systems is subject to the third party’s privacy policy. 

 

YOUR CHOICES.

Some jurisdictions give you a right to make the following choices regarding your personal information:


•    Access To Your Personal Information & Right of Portability. You may request access to your personal information, or confirmation that we have information about you. In certain limited circumstances, you may also request to receive access to your data in a portable, machine-readable format.


•    Changes/Correction To Your Personal Information. We rely on you to update and correct your personal information. Most of our websites and mobile apps allow you to modify your account profile. If our website does not permit you to update or correct certain information, you can contact us at the address described below in order to request that your information be modified. You may ask us to correct information that is inaccurate or incomplete. Note that we may keep historical information in our backup files as permitted by law.


•    Deletion Of Your Personal Information. You may request that we delete your personal information. If required by law, we will grant a request to delete information, but you should note that in many situations we must keep your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another business purposes. If you are a resident of the State of California under the age of 18, you may also request and obtain removal of user-generated content you have posted on our platform (though please note that such a request does not ensure complete or comprehensive removal of all user-generated content, particularly where user-generated content has been republished or reposted by another user or third party).  


•    Opt-out of Targeted Advertising. You may opt-out of online tracking based targeted advertising (e.g., cookies) by clicking the Cookie Settings. Please note that if you change browsers or computers, or if you clear your browser’s cache, you may need to click the link again to apply your preference. You may also opt-out of other forms of targeted advertising, such as our use of advertisements that target you on social media, by submitting a request, as described below, to the email address or telephone number listed under Contact Information.  Please note that we do not currently recognize the “Do Not Track” signal.  

 

•     Right to Know: The right to confirm whether we are processing personal data about you and, for residents of California and Oregon law only, to obtain certain personalized details about the personal data we have collected about you, including: 

  • The categories of personal data collected; 
  • The categories of sources of the personal data; 
  • The purposes for which the personal data were collected; 
  • The categories of personal data disclosed to third parties (if any), and the categories of recipients to whom this personal data were disclosed; 
  • The categories of personal data shared for targeted advertising purposes (if any), and the categories of recipients to whom the personal data were disclosed for these purposes;

 

  • Right to Control Over Sensitive Personal Data: The right to exercise control over our collection and processing of certain sensitive personal data.


•    Promotional Emails. You may choose to provide us with your email address for the purpose of allowing us or our affiliates to send free newsletters, surveys, offers, and other promotional materials to you. You can stop receiving promotional emails by following the unsubscribe instructions in emails that you receive. If you decide not to receive promotional emails, we may still send you service related communications.


•    Promotional Text Messages. If you receive a text message from us that contains promotional information you can opt-out of receiving future text messages by replying “STOP.”


•    Revocation Of Consent. Where we process your personal information based upon consent, you may revoke consent. Please note, if you revoke your consent for the processing of personal information then we may no longer be able to provide you services.


Please note, not all of the rights described above are absolute, and they do not apply in all circumstances. In some cases, we may limit or deny your request because the law permits or requires us to do so, or if we are unable to adequately verify your identity. We will not discriminate against individuals who exercise their privacy rights under applicable law.

Note that, as required by law, we will require you to prove your identity. We may verify your identity by phone call or email. Depending on your request, we will ask for information such as your name, the last item you purchased from us, or the date of your last purchase from us. We may also ask you to provide a signed declaration confirming your identity. Following a request, we will use reasonable efforts to supply, correct or delete personal information about you in our records.


In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. If you are an authorized agent submitting a request on behalf of an individual, you must attach a copy of a completed Authorized Agent Designation Form indicating that you are able to act on another person’s behalf.

 

Appealing Privacy Rights Decisions

 

Depending on your state of residency, you may be able to appeal a decision we have made in connection with your privacy rights request. All appeal requests should be submitted by replying to the communication resolving your original request.

 

HOW WE PROTECT AND RETAIN INFORMATION.

No method of transmission over the internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. In the event that we are required by law to inform you of a breach to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

 

Some of our websites permit you to create an account. When you do you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. You should notify us of any unauthorized use of your password or account.

 

We do not, as a matter of business practice, retain personal data longer than necessary for the purposes stated and to comply with legal requirements, unless otherwise agreed to by you. At the end of the applied retention period, we shall delete your data without it being required that any further information be provided to you.

For your convenience, we may provide links to websites and other third-party content or services that we do not own or operate. The websites and third-party content to which we link may have separate privacy notices or policies. Please note, we have no control over the privacy practices websites, or services that we do not own. We encourage you to review the privacy policies of any third-party website or application for details about such third party’s privacy practices.

CHANGES TO THIS PRIVACY POLICY.

We may change our Privacy Policy and practices over time. Any changes to this Privacy Policy will become effective upon publication of the revised Privacy Policy on the Hublot website.
